Terms of Use

1. Acceptance of Terms

By accessing or using The Photo Restore (“Service”), you agree to be bound by these Terms of Use (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

The Photo Restore provides online photo restoration and enhancement tools, including:

  • Scratch repair
  • Facial enhancement (especially for portraits in older photos)
  • Black-and-white colorization
  • Resolution upscaling

The Service is accessible via thephotorestore.com and related domains. Some restoration features are powered by third-party AI model providers (for example, Replicate) or models hosted by us.

3. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

4. Accounts & Authentication

  • Registration – You may use the Service anonymously (with limited free credits) or by creating an account via Supabase authentication.
  • Accuracy of Information – You agree to provide accurate account information and maintain its security.
  • Account Responsibility – You are responsible for all activity under your account.

5. Credits & Subscriptions

  • Credits – A Credit represents the currency used for photo restoration services. Credits are deducted from your balance when you upload a photo and initiate processing. The number of Credits consumed depends on the restoration options selected, such as colorization and face restoration.
  • Free Credits – Free accounts receive limited free credits.
  • Purchasing Credits – Additional credits can be purchased via:
    • Subscriptions (Starter, Standard, Pro – monthly or yearly renewal)
    • One-time Credit Packs
  • Eligibility – Anyone can buy Credit Packs, but only active subscribers may receive discounted prices.
  • Credit Expiration – Subscription Credits expire if you cancel auto-renewal and your subscription period ends. They do not carry over to the next billing period. Credits purchased as part of a Credit Pack never expire.
  • No Cash Value – Credits have no monetary value and are non-refundable except where required by law.
  • Credit Reversal - If processing fails due to a system error or times out without delivering results, we will reverse the deducted Credits to your account balance. In all other cases, Credits are non-reversible once deducted, including (but not limited to) situations where:
    • You close the browser or leave the page before processing completes.
    • You fail to download or save the restored image after successful processing.
    • The restoration results do not meet your personal expectations.

6. Payments & Billing

  • Payment Processing – Payments are processed securely by Stripe. We do not store any payment method or complete payment card details.
  • Billing Cycles – Subscriptions auto-renew unless canceled before the renewal date. You may cancel anytime by turning off auto-renewal; your subscription will remain active until the current billing cycle ends.
  • Credit Issuance – Subscription Credits are issued immediately upon activation and on every successful renewal. Yearly subscribers receive their full annual Credits immediately after activation.
  • Taxes – You are responsible for any applicable taxes.

7. Photo Processing

  • Use of Photos – You retain all rights to your photos. We process them solely to deliver the requested restoration and enhancement.
  • Third-Party Processing – Photos may be sent to third-party AI model providers (for example, Replicate) as part of the restoration process.
  • Retention – Uploaded photos are not stored in your account and are deleted from our active systems within 24 hours after processing completes.
  • Model Training – We do not use your photos for AI model training.

8. User Conduct

You agree not to:

  • Upload illegal, harmful, or infringing content.
  • Use the Service to violate any laws or rights of others.
  • Attempt to reverse engineer, bypass security, or exploit vulnerabilities.

9. Intellectual Property

  • Service IP – The Service and its contents (excluding your photos) are owned by us or our licensors.
  • Limited License – We grant you a limited, non-exclusive, non-transferable license to use the Service for personal or authorized business purposes.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that restored images will meet your expectations or that the Service will be uninterrupted or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or special damages, including loss of data, profits, or goodwill, arising from your use of the Service.

12. Indemnification

You agree to defend, indemnify, and hold harmless The Photo Restore and its affiliates from claims, damages, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account and access to the Service at our discretion if you violate these Terms or misuse the Service. You may stop using the Service at any time.

14. Changes to the Terms

We may update these Terms from time to time. Updated versions will be posted with a new Effective Date. Continued use of the Service after updates constitutes your acceptance.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
